All images are © [2025] Portraits San Diego and may not be copied, reproduced, or duplicated in any form without the written permission of the artist. Portraits San Diego reserves the right to use any original photograph for display, sample, and promotional purposes, excluding commercial sale, unless otherwise requested in writing. Clients who wish to maintain privacy may submit a written request prior to their session.
• It is understood this Studio/Photographer is the exclusive official photographer retained to perform the photographic services requested on this Contract.
• Upon signature, the Studio/Photographer shall reserve the time and date agreed upon. A 50% non-refundable retainer is required to secure the booking. The remaining balance is due no later than the day before the event.
• If cancellation occurs 30 days or more prior to the scheduled date, the retainer may be refunded in full. Cancellations made within 30 days of the event are non-refundable. Clients may reschedule the session and transfer the balance to a future date, subject to photographer availability.
• If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of the studio/photographer, the photographer may elect to use an alternate location or to reschedule the portrait.
• No part of any order, including previews, will be delivered until the balance is paid in full.
• The Studio/Photographer reserves the right to use images created under this contract for advertising, display, publication, or other purposes. The Client signing this contract warrants that they have the authority to grant the use of likenesses and shall indemnify the Studio/Photographer in the event of any litigation. All images, negatives, and files remain the exclusive property of the Studio/Photographer.
• Studio/Photographer may substitute another competent photographer in the case of illness or scheduling conflict.
• If the Studio/Photographer cannot perform this Contract due to fire, casualty, strike, act of God, illness, or any event beyond the photographer’s control, the liability is limited to a return of all payments received. The Studio/Photographer is not liable for materials lost due to mail issues, camera failure, or lab errors without fault.
• Client understands that color dyes in photography may fade or shift over time. The Studio/Photographer is not liable for such natural changes.
• The charges in this Contract are based on the Studio’s/Photographer’s current Price List, which may change periodically. Final pricing is based on the rate at the time of booking.
• NOTICE OF COPYRIGHT: All photographs and video content remain the property of the Studio/Photographer. Unauthorized reproduction is strictly prohibited and subject to federal penalties.
• This Contract incorporates the entire understanding between the parties and is governed by the laws of ____________________________ (City/County, State). Any changes must be made in writing and signed by both parties.
• Social Media Clause: The Client agrees to refrain from posting any disparaging or negative comments about the Studio/Photographer on social media or public forums. Concerns should be communicated privately and professionally.
